I found this plant in the trash and hope to bring it back to life.
It does have very small new growth(not seen in photo) on the stems.
If you need a new photo I will try to get it.
    Thanks in advance

Are those flowers buds? Or peppers?

I'm not sure, they look like peppers, but they could be buds.
    I'm confused!

wouldn't want to suggest digesting anything that could be poisonous... but have you cut one open yet? Give it a sniff and see if smells like a pepper? Or have pepper-like seeds/veins?
My first guess at looking at the photo was... pepper plant because of the green, yellow and red pod-looking things.

I'm thinking it is a greatly stressed pepper. It looks like one of those ornamental ones that is used for flower beds. Looking like it hasn't enough light. my suggestion is to prune it back and remove any of the buds or fruits and place it where it will get filtered light and see what happens.

I agree with Cheryl and Carolyn about it being an ornmental pepper. Cut it back to just above the first set of emerging shoots and give it some tender, loving care. If it shows signs of improving you've done the right thing. You can then make sure it has enough light, water and feed and it should flourish for you. Do let us know how it does won't you?
