    With that staring eye i might think a Bird of Prey,..Falcon or Hawk.

    Yes - Philip got my guess - bird of prey. I'd say a hawk (but couldn't identify which one)

    Another correct answer, close enough. This is Audubon's warbler, Setophaga auduboni or Setophaga coronata auduboni.
