My Neighbor's Garden On My Land!

    Well, When we first told them we were going to have it surveyed he said. "now do you really think we would just go ahead and use someone else's property?" I thought, OH hear we go........

    When we showed them the survey map, he about fell over and died. He must have been a little embarrassed but I hope I made him feel comfortable about it. I talked a little in jest. No sense in starting off in a hostile way.

    Wow Barb, it sounds like you have handled it very well. I think it could have easily gotten dicey! Congrats on your "new" land!

    You handled the situation well, and I'm so pleased that your neighbour had the good sense to not cause trouble. I wonder what you'll decide to do with it. :D

    You are lucky, but would recommend you keep the survey stakes in, even if you don't have a fence. This happened with my parents neighbors on both sides of them. Turned out ok. With the first, my dad just planted some trees. The other side, it happened gradually with a couple of sales on the neighbor property with a border juniper hedge, when my parents were getting elderly. The neighbors actually were the ones who found out, when did a survey, and worked it out by buying the strip of land from my parents.

    It happened to my father-in-law also, with a neighbor (a judge) encroaching on both of his neighbors. On my FIL side, it resulted in bad feelings, and on the other side, the young couple had to sue to judge, the judge lost and has to look at a large fence the young couple put up to keep him out (so even worse bad feeling).

    We will keep the pond going. It doesn't really need electric for a filter. It should go fine with plants from our big pond for oxygen.

    We will keep most of the plants she has in there and will plant farther down the little hill. It will become all garden in the Spring. Probably grasses on top alone what is now their driveway.

    We have stakes there and plus the survey work is on file with the court house.

    What has been mulched is only a third of what they were using of my property. It goes on for 60 feet more. They have moved out and no one is there so now is the time for us to do this. The old people were embarrassed that they used our land and still remain friendly. We let them enjoy the garden and pond until they left. It turned out fine.

    I would put up some kind of permanent marker on the line once you get it straightened out. I may have a problem like that with one neighbor, but do not have the means to have the line surveyed. And it may be too late ? The kitchen of their mobile home [bought from the previous owner who admitted the mistake, but did nothing] may be over my line. The marker was there on that corner but disappeared when her mobile home was put in. I bought my place before the first owner mentioned bought that land behind mine.

    I once had Google Earth, but did not know you could check boundary lines. How do you do that on there ? I could download it again.

    Thank you all. Allot will get done in the coming weeks. First thing is to get the weeds out from around the little pond. It is out of control. we have some plants already to add. We just ran out of time. glad you all like it. Hubby was pleased when I read your comments.

    You're doing a grand job Barb. Thank goodness you have everything sorted out before new neighbours move in. It may be a lot of hard work but it's certainly worth it to have all that extra land.

    That is a delicate situation. We've been encroached on two sides. One with permission, one without. I let a neighbor vegetable garden over my property line in the summer. The other built a fence that's actually on my side of the property line but its down in the trees so I don't really care. It will get corrected though upon rebuild someday. We have an odd shaped lot which doesn't help.

    Edit... wow I'm viewing from a phone and didn't even see the 2nd page of posts! Your proprty is lovely and your new space is shaping up great.
